These Terms of Service ("Terms") govern your access to and use of AI Visibility Probe, operated by Deacon Hill LLC, doing business as nonBot AI ("nonBot AI," "we," "us," or "our"), including the website, application, APIs, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
Eligibility and Accounts
You must be at least 18 years old to use the Service.
To access certain features, you must create an account. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
We may suspend or terminate accounts that violate these Terms or pose risk to the Service or other users.
Description of the Service
The Service provides tools to analyze how businesses, brands, or entities appear in AI-generated outputs ("AI Visibility"), including the execution of prompts, collection of AI responses, and evaluation of brand presence, sentiment, and positioning.
The Service may change over time. We may add, remove, or modify features without notice.
Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe intellectual property or proprietary rights
- Submit malicious code, automated abuse, or excessive requests
- Attempt to reverse engineer, scrape, or interfere with the Service
- Misrepresent affiliation with any entity or individual
You are responsible for ensuring that URLs, prompts, and inputs you submit comply with applicable laws and third-party terms.
AI Outputs and Limitations
The Service relies on third-party AI models to generate outputs. These outputs are probabilistic and may be inaccurate, incomplete, biased, outdated, or misleading.
You acknowledge and agree that:
- AI outputs are provided for informational and research purposes only
- Outputs do not constitute legal, financial, medical, or professional advice
- You are solely responsible for how you interpret and use outputs
nonBot AI does not guarantee accuracy, completeness, or reliability of any AI-generated content.
Data and Content Ownership
You retain ownership of content you submit to the Service, including URLs, prompts, and custom inputs.
By using the Service, you grant us a limited license to process, store, and analyze submitted content solely to operate and improve the Service.
AI-generated outputs, evaluations, and derived metrics may be stored and associated with your account for historical comparison and product functionality.
Third-Party Services
The Service integrates with third-party providers, including:
- AI model providers (e.g., OpenAI)
- Cloud infrastructure providers
- Analytics and telemetry services
Your use of the Service is subject to the terms and policies of those providers where applicable. We are not responsible for third-party services beyond our contractual control.
Fees and Billing
nonBot AI offers a combination of free and paid subscription plans. At launch, this includes one free tier and multiple paid tiers with varying features, usage limits, and pricing. Details for each plan—including pricing, included features, usage limits, and billing frequency—are made available on our website or within the Service prior to purchase.
By selecting a paid plan, you authorize Deacon Hill LLC, doing business as nonBot AI, or its third-party payment processor, to charge the applicable fees to your chosen payment method on a recurring basis (monthly or annually, as disclosed at the time of purchase). Fees are billed in advance unless otherwise stated.
You are responsible for all applicable taxes, duties, or similar governmental assessments associated with your subscription, excluding taxes based on our net income.
Subscriptions automatically renew at the end of each billing period unless you cancel prior to the renewal date. You may cancel your subscription at any time through your account settings, and cancellation will take effect at the end of the current billing period. No partial refunds or credits are provided for unused time, usage, or downgrades unless expressly stated otherwise.
All fees are non-refundable, except where required by law or where explicitly stated in writing by nonBot AI. We reserve the right to change pricing, introduce new fees, or modify plan structures at any time. Any pricing changes will take effect at the start of your next billing cycle, and we will provide reasonable notice of material changes.
If a payment fails or your account becomes delinquent, we may suspend or restrict access to paid features until payment is successfully processed.
Service Availability
We strive to provide reliable access but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Termination
You may stop using the Service at any time.
We may suspend or terminate your access immediately if you violate these Terms or if continued use could cause harm, legal exposure, or system instability.
Upon termination, your right to use the Service ceases. Data retention is governed by our Privacy Policy.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
To the maximum extent permitted by law, nonBot AI shall not be liable for any indirect, incidental, consequential, or special damages, including loss of data, revenue, or business opportunities, arising from or related to use of the Service.
Our total liability for any claim shall not exceed the amount paid by you to use the Service in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless nonBot AI from any claims, damages, or liabilities arising from your use of the Service, your submitted content, or your violation of these Terms.
Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
